“Claim Centric” Approach
The Small Patent Law Group challenges inventors to define the invention as broadly as possible without encompassing the prior art. SPLG works with inventors to identify all potential points of novelty, alternative embodiments, and fields of use. SPLG attorneys prepare applications using a “Claim Centric” approach beginning with the claims. The claims then serve as a guide to the drafting attorney when building the description around the points of novelty. Claims are drafted based on who in the market will directly infringe and whether competitors sell systems, sub-systems, software, etc. SPLG strives to draft claims in the form easiest to detect infringement and consider licensing opportunities beyond the core business.
